Notarial Services

A. Acknowledgment of Employment Contracts

    PRIMARY DOCUMENTARY REQUIREMENTS

  • Personal appearance of the principal signatories in the contract;
  • Copy of the Philippine passport and the valid Cambodian work visa of the Filipino employee;
  • Copies of the employer’s passport and valid Cambodian work visa, if he/she is non-Cambodian. If the signatory is a Cambodian citizen, a copy of the National ID Card would suffice;
  • Copy of valid Company Registration with the Ministry of Commerce of Cambodia or with other relevant Cambodian government entities;
  • Valid work permit of the Filipino employee reflecting the name of his/her company (Note that: 1. SELF-EMPLOYED status is not considered an OFW per the DMW; and 2. Work permits must be VALID);
  • Copy of last Overseas Employment Certificate (OEC) issued by the Department of Migrant Workers, if applicable;
  • Original employment contract compliant with the minimum provisions prescribed by the DMW;

    SUPPLEMENTARY DOCUMENTARY REQUIREMENTS

  • Foreign worker quota as approved by the Ministry of Labour and Vocational Training (MLVT), if the worker is new in the company
  • If the employer is not present in Cambodia or unable to accompany the worker to the Embassy, an Authorization Letter must be executed by the employer stating that the company is assigning a representative to co-sign the worker's employment contract and transact with the Philippine Embassy on the employer’s behalf.

IMPORTANT: Other requirements may be requested by the consular processor to facilitate the complete evaluation of the transaction. 

NOTE: Under the DMW rules, an overseas company may only directly hire a maximum of five (5) Filipinos. If the company intends to hire more Filipinos, it should hire through a POEA-accredited recruitment agency in the Philippines. ( MC-08-2018-Guidelines-on-Registration-of-Direct-Hires )

 

B. Affidavits and Special Power of Attorney (SPA)

    REQUIREMENTS

  • Personal appearance of the affiant
  • Duly accomplished SPA form
  • Passport with photocopy of the data page
  • Processing Fee: USD 25, in cash
  • Processing Time: three (3) working days

Reminder: The documents being executed by the affiant must be signed by two witnesses.

C. Authentication of documents issued in Cambodia for use in the Philippines

     REQUIREMENTS

  • Document(s) to be authenticated bearing the seal, signature, and name of an Embassy-accredited Cambodian Notary Public or by the duly-authorized signatory of the Consular Department of the Ministry of Foreign Affairs and International Cooperation (MFAIC)
  • Valid passport and photocopy of the data page
  • Processing Fee: USD 25, in cash
  • Processing Time: three (3) working days

D. Affidavit of Invitation and Support (for purposes of presentation to the Bureau of Immigration in the Philippines)

     REQUIREMENTS

  • Personal appearance of the affiant
  • Valid passport with photocopy of the data page of the affiant and of the invitee
  • Proof of relationship with the invitee (e.g. birth certificate, marriage certificates, etc.)as well as the passport of the invitee with photocopy of the data page
  • Copy of the current employment contract of the person inviting, with sufficient proof of financial capacity
  • Copy of the round-trip airline ticket of the invitee
  • Processing Fee: USD 25, in cash
  • Processing Time: three (3) working days

E. Passport Certification

     REQUIREMENTS

  • Personal appearance
  • Passport/s with photocopy of the datapage
