Transitional Fines on Individual Who Intentionally Does Not Comply with Administrative Measures in Preventing the Spread of Covid-19 and Other Severe and Dangerous Contagious Diseases in Phnom Penh

Hereby Decides:
Article 1
Transitional fines on individual who intentionally does not comply with the administrative measures issued by the Royal Government of Cambodia and Phnom Penh Municipal Administration in preventing the spread of Covid-19 and other severe and dangerous contagious disease shall be set forth as follows:

Article 2
An officer qualified as a judicial police officer of Phnom Penh Municipal Administration must issue a receipt of transitional fine to the person who intentionally does not comply with the above-mentioned administrative measures and instruct the person to pay the transitional fine depending on the act that was committed within the duration of 30 (thirty) days, from the date of receipt of the transitional fine.
When receiving payment of transitional fine, either in cash or check, the officer must use receipt that was printed and given by the Ministry of Economy and Finance.
Receipt of transitional fine must be made in three (3) copies. One copy is given to the person who intentionally does not comply with the administrative measures, and the other two are kept as record.
Article 3
Revenue received from the collection of transitional fine paid by the person who intentionally does not comply with the administrative measures will be recorded as revenue of Phnom Penh Municipal Administration.
Article 4
In case a person who intentionally does not comply with the administrative measures refuses to pay transitional fine within the duration of 30 days, from the date of receipt of the transitional fine, officer qualified as a judicial police officer of Phnom Penh Municipal Administration must prepare the case and file complaint to the court in accordance with the procedures in force.
Article 5
In addition to the above-mentioned transitional fine, in case where the act of intentionally not complying with the administrative measures as determined in article 1 of this decision causes an infection of Covid-19 to other people or lead to serious impact on public health, the offender will be punished by imprisonment or transitional fine in accordance with article 10 of Law on Preventive Measures Against the Spread of Covid-19 and Other Serious and Dangerous Contagious Diseases.
Article 6
Any provision contrary to this Decision shall be abrogated.
Article 7
The Chief of Phnom Penh Municipal Administration, Chief of Phnom Penh Police Commissariat, Commander of Phnom Penh Royal Gendarmerie, Governors of 14 Districts, Director of Municipal Department of Economy and Finance, Director of Phnom Penh Municipal Treasury, directors of departments and units operated under Phnom Penh Municipal Administration must take action in carrying out duties outlined this Decision effectively, starting from the signing date onward.
